Lawrence Luttrell, a Holmdel attorney, has filed suit against Monmouth County on behalf of a new non-profit corporation, Residents Against Government Exploitation (RAGE), over the government purchase of the development rights to Manalapan Township Committee Member Andrew Lucas’ farm for $1.152 million.
The plaintiff non-profit could be called LAGE, Luttrells Against Government Exploitation. The trustees of the entity are Luttrell, his wife and his mother.
Luttrell is a Democratic candidate for Monmouth County Freeholder.
The all Republican Monmouth County Board of Freeholders passed a resolution by a 3-2 vote on February 28 to join the Township of Manalapan and the State of New Jersey in purchasing the development rights to the Lucas property for farmland preservation. The county contributed $277,920, Manalapan paid $186,969 and the State picked up $687,111 of the purchase. Freeholders Lillian Burry, Gary Rich and Serena DiMaso voted in favor of funding the purchase. John Curley and Freeholder Director Tom Arnone voted no.

Could John Bennett be heading back to Trenton?
…Senator Joe Kyillos?
By virtue of his long term friendship with Governor Christie and his campaign for U.S. Senate last year, State Senator Joe Kyrillos is on every Christie mind reader’s short list of possible U.S. Senators to replace the late Frank Lautenberg.
Assuming Kyrillos defeats Leigh-Ann Bellew in the primary today, his move to the U.S. Senate would create a vacancy for the nomination for State Senate in LD 13. If either Assemblywoman Amy Handlin or Assemblyman Declan O’Scanlon move up to the Senate slot, as would be expected, there will be an Assembly nomination vacancy.
Neither Handlin nor O’Scanlon will say if they want the State Senate seat, which probably means they both want it. Even so, I would expect that they would work that out amongst themselves rather than have a convention fight.
A nominating convention for the resulting Assembly vacancy would bring out a wealth of Republican talent.

Andrew Lucas will finally get his $1,152,000.
After almost three years since the Manalapan Township Committee Member purchased a 97 acre farm in Iron Ore Road, the Manalapan Township Committe and the Monmouth County Board of Freeholders approved the funding of their respective portion of the purchase of the development rights to the property. Manalapan is paying $186,969.10 of the purchase price. Monmouth County is paying $277,920. The balance is coming from State coffers for the purpose of Open Space preservation.
Manalapan’s all Republican Committee approved their funds, 2-1, on Wednesday evening, according to ManalapanPatch. Committeeman Ryan Green voted no. Deputy Mayor Jordan Maskowitz abstained. Mayor Susan Cohen, the Monmouth GOP Vice Chair, and Committeeman Donald Holland voted to approve the purchase. Lucas recused himself from the proceedings. Maskowitz and Lucas are both up for reelection this November.
The isssue was heated at the Monmouth County Board of Freeholders meeting last night, with John Curley accusing his fellow freeholder, Lillian Burry, of colluding with Lucas. Lucas hosted a fundraiser for Burry at the farm in 2011, according to the Asbuy Park Press. The APP said the exchanges between Curley and Burry were so intense that Freeholder Director Tom Arnone called multiple recesses. Arnone voted with Curely against the purchased. Gary Rich and Serena DiMaso joined Burry in voting for the purchase.
Democratic Freeholder candidate Lawrence Luttrell asked Burry to recuse herself. County Counsel Andrea Bazer advised Burry that she had no conflict that would prevent her from voting.
Former Middletown Democratic Township Commitee candidate Linda Baum also spoke against the purchase on ethical grounds.
The issue has been controversial for years because, while he recused himself from voting as a committee member on the purchase, Lucas participated in deliberations about the transaction. The State Local Finance Board approved the ethics of Lucas’ participation due to the fact that he sought the advice of the Township’s attorney. In their opinion, the Finance Board indicated that they would be issuing new rules to cover future similar circumstances.

Manalapan Township Committeeman Andrew Lucas’ $1.152 million sale of the development rights to a farm in owns in the Township was not approved by his colleagues on the committee this evening. The motion to approve the Township’s $187,000 contribution to the the purchased failed on a 2-2 vote.
Committeeman Ryan Green first moved to table the purchase due to incomplete documentation. Committeeman Jordan Maskowitz voted with Green to table the purchase. Mayor Susan Cohen and Committeeman Donald Holland voted against tabling. Cohen and Holland then voted to approve the purchase. Green and Maskowitz voted no. Lucas the fifth member of the committee recused himself from voting on the purchase of his own property.
Green told MMM that Lucas left the dais when the matter came up and left the building. Lucas did not return for the remainder of the Township Committee meeting.
Green said he has not decided how he would vote when and if the documentation for the sale is completed.
Monmouth County’s portion of the purchase is on the agenda for tomorrow’s meeting of the Board of Chosen Freeholders. The Freeholders will not proceed without Manalapan’s portion of the purchase being approved, according to Freeholder Director Tom Arnone.
Lucas, Manalapan’s former mayor and a former GOP candidate for freeholder, purchased the farm which had been slated for development in March of 2010 for an undisclosed amount. Soon thereafter he started the process of selling the development rights, for $1.152 million, through funding through the State, County and Township. Lucas participated on Township Committee discussions of his application.
The purchase approved by the Freeholder Board in May of 2011 was held up by an ethics complaint filed by former Manalapan Mayor George Spodak. The State Agriculture Development Committee conditioned its funding on an satisfactory ethics review of the transaction. Local Finance Board Chairman Thomas Neff wrote Lucas in September of last year to inform him that his application had been approved because he consulted with the Manalapan Township Attorney about his application. Neff’s letter also said that the Board would use Lucas’s case to provide clear guidance to future office holders to recuse themselves from applications that they have an interest in.
Arnone and Freeholder John Curley have announced that they oppose the purchase of the Lucas farm. Freeholder Lillian Burry supports the purchase. Deputy Director Serena DiMaso and Freeholder Gary Rich have not announced how they would vote on the purchase should it make it out of Manalapan.

FREEHOLD, NJ – The Monmouth County Office of Emergency Management urges residents to heed the warnings that have been issued in connection with Hurricane Sandy, currently a Category 1 storm.

Meanwhile, county emergency personnel are continuing to monitor the effects of the storm and respond to the needs of communities. Mandatory evacuations are in effect in all or part of 15 municipalities. Nearly 1,000 residents have sought accommodation at the two county shelters.
“We are expecting Hurricane Sandy to impact the county for at least the next 24 hours,” Mike Oppegaard, Director of the Monmouth County Office of Emergency Management said. “We are hoping that residents have heeded warnings and evacuations and are prepared for the possibility of high winds, power outages and flooding.”
Over the past few days, residents have been encouraged to plan, prepare and stay informed.
“Residents who have created a kit and evacuated to the homes of friends or families or are sheltering in place should be ready to make it through the storm,” Freeholder Director John P. Curley said. “Everyone should continue to monitor local radio and television for the latest information on Hurricane Sandy.”
Oppegaard also reminds residents to be safe with these reminders:
- Do not go outside. Flying debris from high winds is a danger. As the eye of the storm passes, there will be a short period of calm followed by rapid wind speed increases to hurricane force that will come from the opposite direction.
- Avoid using candles for lighting. Use a battery-powered flashlight.
- Try to stay in an interior room away from windows.
- If flooding occurs, turn off electricity at the main breaker.
- If your power goes out, turn off your major appliances. This will minimize losing power again through a power surge and protect the equipment when power returns.
- Stay calm and do not call 9-1-1 unless it is an emergency.
Monmouth County Sheriff Shaun Golden echoed the 9-1-1 reminder.
“Calling 9-1-1 for the wrong reason or calling the number inadvertently may keep someone else from getting the help they need,” Golden said. “If you do call by mistake, please stay on the line until the call taker can confirm that you do not require emergency assistance.”
Do not call 9-1-1 to ask for directions, to check on power, telephone or cable outages, to inquire about road or weather conditions, to get information about public services or to report situations that are not emergencies.
“During severe weather and all other times, residents are reminded to call 9-1-1 only in emergencies that threaten life or property,” Golden said. “These include a fire or serious medical condition, when there is fear for personal safety or the safety of others, or during a crime in progress.”

“Club Monmouth” is kaput. The Asbury Park Press negative monkier for the Monmouth GOP is obsolete now that their editorial board has endorsed the entire Monmouth Republican slate using the adjectives “innovative.” independenct,” and “effective.”
Accordingly, MMM is retiring the moniiker “Neptune Nudniks,” for now, that we have used for the last few years in naming the APP Editorial Board.
Their endorsements of John Curley and Serena DiMaso for Freeholder are right on the mark.
Curley has demonstrated leadership, independence and fiscal conservatism during his time as a freeholder. His tireless research and persistence in uncovering the excesses and illegalities of former Brookdale Community College President Peter Burnham led to Burnham’s ouster and guilty plea on official misconduct charges this summer.
DiMaso and Curley helped pare $4.1 million from the county’s $487 million spending plan this year, without laying off any employees and keeping property taxes stable. Curley has pledged to continue with plans to consolidate county jobs as people leave and to explore more opportunities to outsource county services.
DiMaso’s insistence on the need for the freeholders to keep our state legislators’ feet to the fire when it comes to the federal government’s lack of transparency with the redevelopment of Fort Monmouth is welcome, as is her focus on continuing to find ways to share services with neighboring counties and municipalities.
As they did in endorsing M.Claire French for County Clerk, the APP simply dismissed the Democratic opposition as not up to the jobs.
“What’s next, endorsing Romney?” one MMM reader asked. That would be something. The APP’s sister publication with the same website design, The DeMoines Register, reversed their 2008 endorsement of Obama yesterday, declaring,
Which candidate could forge the compromises in Congress to achieve these goals? When the question is framed in those terms, Mitt Romney emerges the stronger candidate.
The former governor and business executive has a strong record of achievement in both the private and the public sectors. He was an accomplished governor in a liberal state. He founded and ran a successful business that turned around failing companies. He successfully managed the 2002 Winter Olympics in Salt Lake City.
Romney has made rebuilding the economy his No. 1 campaign priority — and rightly so.

Could they possibly endorse Curley and DiMaso for Freeholders too?
The Asbury Park Press has recognised the fine job Republican County Clerk M. Claire French has done over the last ten years and endorsed her for a third five year term.
The Neptune Nudniks got this one right. They dismissed Democratic candidate Michael Steinhorn as someone who “has little to recommend him for the job,” despite the fact that he exposed the statistical anomaly of the Monmouth GOP winning the first general election ballot position in 30 of 33 years and that they like his proposal to that the clerk’s office provide mobile services to seniors and veterans.
Given their logic in endorsing French, it will be fascinating to see how they endorse at least one of the Democratic Freeholder candidates, as I expect they will.
The Democratic Freeholder campaign has been so anemic that I suspect many readers don’t even know who is running. Despite the Monmouth Dems outraising the Monmouth GOP through September, there is little evidence that Democratic Chairman Vin Gopal and his team are trying to get their nominal slate elected. Publicly Democratic leaders say the right things about supporting their candidates. Privately they seem resigned to a Republican blow out.
The Democratic candidates are William Shea and Kevin Lavan. Shea, as Amy Mallet’s running mate, lost to Freeholders Lillian Burry and Gary Rich last year. He is challenging Freeholder Director John Curley for a full three year term. Lavan, who lost his run for Assembly to Declan O’Scanlon and Amy Handlin in the 13th district last year, is running against Freeholder Serena DiMaso for the remaining one year of Rob Clifton’s term. Clifton resigned upon being sworn into the State Assembly.
Shea and Lavan were not even on the same page when the Nudniks interviewed all four candidates in September. Shea recklessly proposed a 20% across the board spending cut from the county budget without backing up how he would do it. Lavan said “maybe” depending upon the results of an audit.
Yet, the Nudniks loath single party control of any governing body (except the federal government when it is in Democratic hands) and has a historical bias against “Club Monmouth” as they frequently call the Monmouth GOP. They seem to forget that all of the Monmouth Republican county office holders and all of Monmouth GOP leadership has been replaced since Operation Bid Rig, except Claire French who they just endorsed. The GOP holds all five seats on the Freeholder Board.
Will the APP editorial board affirm the nudnikness and endorse Shea or Lavan? We’ll find out soon. Either way, it won’t matter on election day. It might matter to their own crediblity if the actually endorse the best people for the job and get over their own biases.

A group called Friends of Longstreet Farm Animals wants the livestock animals at the Holmdel park to be neutered so they won’t breed and be sold for slaughter, according to an article in the Asbury Park Press.
The leader of the group, Suzanne Dragan of Aberdeen, says she presented the Freeholder Board with a petition with 1,175 signatures and 100 postcards asking that county raised animals no longer be slaughtered.
Freeholder Director John Curley said he sought a compromise with Dragan’s group. When no compromise could be reached, Curley said “I love a good BLT,” while announcing that the farm would continue to breed and sell animals that end up as groceries.
Bruce Gollnick, the assistant director of the county park system, said that farm is trying to do a better job managing the breeding program to control the population so that animals do not have to be sold.
Why?
It seems to me that the proceeds of sales should be defraying the cost of operating the park. No? A breeding and sale program could be/should be an educational opportunity for Monmouth County students of all ages.
Breed more, sell more, slaughter more and serve Longstreet Burgers at the Monmouth County Fair.
Dragan said, “Shame on the freeholders for not listening to their constituents” by continuing the sale of animals that end up being slaughter.

Bill Shea, the young retired State Trooper with a disability pension who is challenging Freeholder Director John Curley for a seat on the Monmouth County Board of Freeholders, called for a 20% across the board reduction in county government spending yesterday. Shea’s running mate, former Hazlet Mayor Kevin Lavan, said Shea’s proposal “is not out of the realm of possibility” and would depend on the results of a county audit.
Shea and Lavan were speaking yesterday to the Asbury Park Press Editorial Board where they appeared along side Curley and Freeholder Serena DiMaso. DiMaso and Lavan are competing to complete the unexpired term of Assemblyman Rob Clifton who resigned in January upon taking office in Trenton. DiMaso was elected by the GOP County Committee to serve in the seat until the general election results are certified.
Curley and DiMaso said such cuts would be impossible to achieve, according to APP. They said such cuts would annihilate small county departments and cripple to county’s efforts to reduce municipal spending with shared services.
