Lucas Found Guilty

andrew lucas

Andrew Lucas

Former Manalapan Mayor Andrew Lucas has been convicted of all the charges against him by a federal jury in Trenton, according to a report in The Asbury Park Press.

The jury deliberated for three hours after a two week trial before U.S. District Judge Freda L. Wolfson.

Lucas, 37, is scheduled to be sentenced to federal prison on January 20, 2015.  He remains released on $500,000 bail, subject to home confinement and electronic monitoring, according to Matthew Reilly, Deputy Public Affairs Officer of the U.S. Attorney’s Office.  Lucas could face over 60 years in prison for his wire fraud, making an illegal monetary transaction, loan application fraud, making false statements to the Internal Revenue Service, aggravated identity theft, obstruction of a grand jury investigation and falsification of records in a federal investigation convictions.

The former mayor’s crimes occurred as he was applying for financing to acquire the 97 acre Burke Farm in Manalapan. After he acquired the farm, he sold the development rights to New Jersey’s Farmland Preservation Program for $1.2 million, netting a profit of $450,000 and retaining ownership of the farm.   The $1.2 million was funded by the taxpayers of New Jersey, Monmouth County and Manalapan.

The federal investigation started as an inquiry into the sale of the development rights to the Farmland Preservation Program, according to a source close to Lucas’s legal team. There was no wrong doing found in the Farmland Preservation deal. However the investigation extended into Lucas’s finances and revealed the irregularities in his application for financing to acquire the farm.

I find it disturbing that a politically motivated investigation which turned out to be completely baseless led to his conviction on unrelated charges for a crime where no one was hurt, no one lost money and therefore there is really no victim.
You have to wonder how many people could withstand the microscopic scrutiny of federal prosecutors rifling through their life because someone made baseless charges?

Can someone other than know it all JCG or one of his alter egos explain, or provide a link explaining, the legal differences between Corzine’s crime and Lucas’ “crime” beyond a stereotypical “duh, he’s a democrat!” horsecrap? Aren’t both cases essentialy paper fraud? Why does Lucas’ punishment seem much more harsh in comparison? Is there a person or department a citizen with no direct relation to the “crime” or “criminal” can contact for more information or a person or department to complain to if a court case and sentence seens unfair as it would be in the public’s best interest to ensure there are good legal precendants and cases established should anyone of us be accused or convicted of such “crimes” and ensure that punishments are equal and fair, like is our right.

    Thank you.

Since you chose to attack me, I’ll choose to respond. Ask yourself, was John Corzine taken to criminal court?

The answer was, he wasn’t. That may have been wrong not to charge him criminally but that is your answer. That you couldn’t use the internet and your own common sense to figure that out on your own shows your lack of capability in dealing with facts. So yeah, maybe it takes a know it all to teach you something.

I’d rather be a “know it all” that someone like you who can’t figure things out.

Yeah, I know you’ll hate (even more) me in morning for this, but what the hey? You picked the fight. Deal with the response.

Secondly, you think too much of me re: this “alter ego crap” that people keep trying to pin on me. I ain’t got the time for games.

Now, while we are talking about the theory of alter egos, why don’t you have some cohones, stop being a coward and use your real name like I do?

You won’t because you are a coward that hides behind the anonymity of a computer screen to attack someone. Gee, I wonder how many screen names YOU have used in the past. Betcha it ain’t one. You see, I’ve been working with people all of my working life in sales and management. And I can smell BS even if it’s on a computer screen.

Have the guts to use your real name and you might be more believable. You people want to keep playing games like this and personally attack me? I’ll keep heaping this kind of response on your.

Honestly, it’s really a waste of keystrokes on an important story; but as I said. You guys pick the fight so I’ll just keep on embarrassing you.

You can only be the real joke JR Smith. I told you once, I have told you twice, I will find you and I will humiliate you. You continue with personal insults and your day of reckoning will come.

Again, people who are wrong attack others personally because they have no facts to back up their position. They are small, shallow people with empty souls who denigrate others in order to build up their own meaningless life soul in a failed attempt to have something to pat themselves on the back for.

You think your weak kneed attempts bother me son bother me son? I’ve got a thicker skin than that.

You know what your problem is? You can’t handle facts.

When Art takes down personal attacks on me, he is welcome to take down my return fire.

Like I said prior, I think a much better strategy would have to taken a plea deal (assuming one was offered.) Going to trial and basically admitting to the charges left the jury no option other than to convict and now he is facing significant minimum sentences on these charges.

  13. @Jim said at 8:37 am on September 20th, 2014:

All you do is call Democrats names.Talk as if you know everything. When do you become GOD?You need to learn and acceptance not everyone agrees with your thinking.

  14. So the answer is said at 9:30 am on September 20th, 2014:

So the answer from Jim is he doesn’t know but i’m sure he’ll waste more keystrokes to get the last word in today.

Do any of the lawyers who participate here understand why Corzine has not been punished for a crime that on paper seems very similar to Lucas’? Both essentially “borrowed” from other people without their permission, Lucus seems to have only borrowed a signature and there has been no monertary loss that I’ve read of but Corzine borrowed actual money. Why arent federal prosecutors investigating to the same degree or what evidence is missing in the corzine case that they wont charge him with a crime or punish him in the same way?

  15. Why must we said at 9:53 am on September 21st, 2014:

devolve into personal nitpicking and attacks here? Stick to the issue: this is a tragedy, which happens all too often in public life: some get into positions if leadership, then ego, arrogance, and personal agendas take over, rather than sticking to the common good: this young man was apparently so arrogant that, he will be lucky to be out in time, to walk his little girls down the aisle, and raise his new child, which we are told is still on the way.. No matter how one feels, this is a sad commentary on the realities of life, today.

  16. Jim Granelli said at 7:19 pm on September 21st, 2014:

    @ Why must we.

EXACTLY. But you know, sometimes insulting and hateful children need a spanking.

    @ So the answer is.

You know, I go away and have a nice weekend with the family, and I gotta see your smut here when I get back..

Here’s the problem. YOU asked the wrong question. You asked:

“Why does Lucas’ punishment seem much more harsh in comparison?” To wit, I responded, with a question, that should have led you to the answer that since Corzime wasn’t in criminal court, there could not be similar punishment and and hence Luca’s sentence will be harsher.

That was a “Stuck On Stupid” moment for you.

You see, now; if you had asked the question “Why was Lucas charged and not Corzine for what appears to be a similar crime,” I might not have responded since I don’t know that reason.

So, the answer to your question “why has Corzine not been punished for a crime that on paper seems very similar to Lucas” IS STILL, Corzine hasn’t been charged criminally. You can’t punish someone similarly until they are found guilty of, as you put it; “a similar crime.”

Now, as to “wasting keystrokes.” There is something to be said for walking away from situations and letting fools embarrass themselves. However, since this has returned to a “bash Jim Granelli” series of events lately, I promised certain people I will continue to illustrate how hateful you are.

YOUR PROBLEM is that you don’t realize how childish and foolish you look by continuing such antics. Act like a child, get treated as a child. Hate, and you continue to be exposed as haters.

And, when I have the time, a certain few posters here will find out how serious I am about stopping this kind of crap.

You want to talk issues, fine. Keep it there and be able to seriously debate the refutation of your position and handle losing like an adult.

Continue the hate, and get a spanking right back; and then sent to the corner.

    @ @ Jim

I don’t demand people accept my way of thinking. I’m just believe I should be helping to defeat your way of thinking if it is liberalism because liberalism has nearly killed our country. And I long ago, stopped subscribing to PC speech. That’s half the problem. We’ve become a nation of wusses, afraid to deal honestly and openly with an issue because we are afraid of hurting someone’s feelings.

    I just don’t do BS.

BTW, you haters can not even begin to hurt my feelings or think that you can push me away from here. I’ve got a thick skin. But it seems that my responses get under YOUR skin because of the facts I nearly often provide.

You just can’t handle a true debate in the arena ideas. More often than not, you defer to one of the attack points (or similar) listed in this article :

    http://canadafreepress.com/index.php/article/60255#.Us7jMPtKL-t

OOOPS. Most of the haters here simple defer to the first one, and issue Ad Hominem attacks against me.

    Schools out for the day….

  17. So Jim wasted more keystrokes said at 9:00 pm on September 21st, 2014:

And still can’t answer an intelligent question but wastes plenty of keystrokes patting himself on the back.

What is evidence is missing from the Corzine case that he goes unpunished? What evidence exists in Lucas’ case that you assume must be missing in the Corzine case? Is there a state or federal board one citizen can ask to review what seem like similar cases or file formal complaints if a prosecutor or jury seems to have violated the 8th Amendment and is excessively punishing someone or punishing them in an unusually harsh manner compared to what seems like a similar case.

Still not an answer Jim. It’s ok to not answer, Jim, if you don’t know or have a relevant opinion. You don’t need to have the last comment on every topic.

Let’s stick to the issue here…. What is different between Corzine and Lucas’ “crimes”, why is Lucus being punished and Corzine not? Who can the public formally complain to about what seems like a violation of the 8th Amendment?
    * A severe punishment that is obviously inflicted in wholly arbitrary fashion. (arbitrary: Lucus punished, Corzine, not)
    * A severe punishment that is patently unnecessary. (unnecessary: federal prison for a paperwork violation where no one was hurt and no one lost money)

@ still nothing, and I do mean NOTHING.

I really don’t have time to debate this morning. So, I’ll just leave a few links for people to read, if they choose to.

It seems no one wants to bother playing with you because you ARE NOTHING but a broken record, so I’ll spend a few moments.

QUOTE: After nearly two years of stitching together evidence, criminal investigators have concluded that porous risk controls at the firm, rather than fraud, allowed the customer money to disappear, according to the law enforcement officials with knowledge of the case.

QUOTE: On the other hand, the word “fraud” is never mentioned in the CFTC’s complaint. An anonymous lawyer suggested to Reuters that there didn’t seem to be much in the way of actual fraud in the case.

    http://www.huffingtonpost.com/2013/06/28/criminal-charges-mf-global_n_3516652.html

SO, IN THE CASE OF LUCAS V CORZINE:

It was determined by Federal investors, that it was not fraud, where in the Lucas case, not only was it proven that fraud was committed, but Lucas admitted to mistakes. IMHO, that was an attempt to garner mercy; while Lucas knew he screwed up and fraud was proved in his case.

    NEXT QUOTE:

“The criminal probe into whether there was wrongdoing on the part of Corzine by the Department of Justice will now be dropped due to lack of evidence, said a report in The New York Post, citing a person with knowledge of the matter.”

    http://dealbook.nytimes.com/2012/08/15/no-criminal-case-is-likely-in-loss-at-mf-global/?_php=true&_type=blogs&_r=0

NOT SAYING THE OUTCOME WAS CORRECT, just commenting on how the outcome came about. And we all know civil penalties are different than criminal penalties, right NOTHING?

But then, these things could have easily been found by the anonymous and cowardly poster, simply by typing the following into the search bar:

    “why was corzine not charged”

However, this coward was either too lazy or preferred to continue personal attacks despite me trying to lead a horse to water with my previous comments.

Ain’t life fun folks? You see, it is really easy to defeat people like this with the facts. Almost a cakewalk.

    Have a nice day 🙂

Jim, it’s really ok if you don’t know the answer or have any understanding of the law or why it’s important for the public to be vigilant and inquisitive in an effort to guard their rights but then you also supported red light cameras, strictly as a revenue source, until O’Scanlon made it uncool. You really don’t need to have the final comment in every story, or a comment in every story. I don’t think there are year end prizes here. Your continued belligerence is detrimental to getting informed opinions from an actual legal experts.

And I certainly do understand why it is difficult, if not impossible, for other Republicans to step up and defend Lucas as it would seem like a wholly partisan defense of “one of their own”, but I reiterate that the public, Republicans, Democrats and Independents along with non-voters, must ensure that established cases and processes for such “crimes” are consistent and fair as there will come a day that any of one of can be arbitrarily singled out and subjected to an indefensible level of scrutiny and punishment.

Hey, since no one else was answering, I wanted to make sure you weren’t alone in your room crying that no one wanted to play with you.

NO LEGAL OPINION WAS REPLYING TO YOU AFTER SEVERAL REQUESTS…

I gave you the best answer I could, based on what I know and could find. I am no lawyer, but gave you a summary of the reasons why that I found on the internet.

If that doesn’t suit you, I am not the problem.

AND ACCORDING TO MY PREVIOUS POST…

Citing several articles, it was a lack of evidence of fraud on Corzine’s matter, as expressed by the prosecutor’s office. What, that’s not good enough for you?

    Talk about carrying on.

Now, contrary to what I said before; I WILL stop responding (making people look foolish) when they stop with personal and cowardly attacks while hiding behind a computer screen.

And what do red light cameras have to do with this issue? Have cohones, name yourself and then maybe I’ll respect you a little more. But you won’t because you are afraid of consequences.
