Lucas Found Guilty
Former Manalapan Mayor Andrew Lucas has been convicted of all the charges against him by a federal jury in Trenton, according to a report in The Asbury Park Press.
The jury deliberated for three hours after a two week trial before U.S. District Judge Freda L. Wolfson.
Lucas, 37, is scheduled to be sentenced to federal prison on January 20, 2015. He remains released on $500,000 bail, subject to home confinement and electronic monitoring, according to Matthew Reilly, Deputy Public Affairs Officer of the U.S. Attorney’s Office. Lucas could face over 60 years in prison for his wire fraud, making an illegal monetary transaction, loan application fraud, making false statements to the Internal Revenue Service, aggravated identity theft, obstruction of a grand jury investigation and falsification of records in a federal investigation convictions.
The former mayor’s crimes occurred as he was applying for financing to acquire the 97 acre Burke Farm in Manalapan. After he acquired the farm, he sold the development rights to New Jersey’s Farmland Preservation Program for $1.2 million, netting a profit of $450,000 and retaining ownership of the farm. The $1.2 million was funded by the taxpayers of New Jersey, Monmouth County and Manalapan.
The federal investigation started as an inquiry into the sale of the development rights to the Farmland Preservation Program, according to a source close to Lucas’s legal team. There was no wrong doing found in the Farmland Preservation deal. However the investigation extended into Lucas’s finances and revealed the irregularities in his application for financing to acquire the farm.
I find it disturbing that a politically motivated investigation which turned out to be completely baseless led to his conviction on unrelated charges for a crime where no one was hurt, no one lost money and therefore there is really no victim.
You have to wonder how many people could withstand the microscopic scrutiny of federal prosecutors rifling through their life because someone made baseless charges?

The APP article, they make it seem like his relative was the one who got scammed in the whole deal. Apparently the relative had no idea he had used his name to start a company and lend himself 250k for the down payment on the property.

Can someone other than know it all JCG or one of his alter egos explain, or provide a link explaining, the legal differences between Corzine’s crime and Lucas’ “crime” beyond a stereotypical “duh, he’s a democrat!” horsecrap? Aren’t both cases essentialy paper fraud? Why does Lucas’ punishment seem much more harsh in comparison? Is there a person or department a citizen with no direct relation to the “crime” or “criminal” can contact for more information or a person or department to complain to if a court case and sentence seens unfair as it would be in the public’s best interest to ensure there are good legal precendants and cases established should anyone of us be accused or convicted of such “crimes” and ensure that punishments are equal and fair, like is our right.

The answer was, he wasn’t. That may have been wrong not to charge him criminally but that is your answer. That you couldn’t use the internet and your own common sense to figure that out on your own shows your lack of capability in dealing with facts. Like I said prior, I think a much better strategy would have to taken a plea deal (assuming one was offered.) Going to trial and basically admitting to the charges left the jury no option other than to convict and now he is facing significant minimum sentences on these charges.

Do any of the lawyers who participate here understand why Corzine has not been punished for a crime that on paper seems very similar to Lucas’? Both essentially “borrowed” from other people without their permission, Lucus seems to have only borrowed a signature and there has been no monertary loss that I’ve read of but Corzine borrowed actual money. Why arent federal prosecutors investigating to the same degree or what evidence is missing in the corzine case that they wont charge him with a crime or punish him in the same way?

Here’s the problem. YOU asked the wrong question. You asked:

You see, now; if you had asked the question “Why was Lucas charged and not Corzine for what appears to be a similar crime,” I might not have responded since I don’t know that reason.
So, the answer to your question “why has Corzine not been punished for a crime that on paper seems very similar to Lucas” IS STILL, Corzine hasn’t been charged criminally. You can’t punish someone similarly until they are found guilty of, as you put it; “a similar crime.”

What is evidence is missing from the Corzine case that he goes unpunished? What evidence exists in Lucas’ case that you assume must be missing in the Corzine case? Is there a state or federal board one citizen can ask to review what seem like similar cases or file formal complaints if a prosecutor or jury seems to have violated the 8th Amendment and is excessively punishing someone or punishing them in an unusually harsh manner compared to what seems like a similar case.

SO, IN THE CASE OF LUCAS V CORZINE:
It was determined by Federal investors, that it was not fraud, where in the Lucas case, not only was it proven that fraud was committed, but Lucas admitted to mistakes. IMHO, that was an attempt to garner mercy; while Lucas knew he screwed up and fraud was proved in his case.

Jim, it’s really ok if you don’t know the answer or have any understanding of the law or why it’s important for the public to be vigilant and inquisitive in an effort to guard their rights but then you also supported red light cameras, strictly as a revenue source, until O’Scanlon made it uncool. You really don’t need to have the final comment in every story, or a comment in every story. I don’t think there are year end prizes here. Your continued belligerence is detrimental to getting informed opinions from an actual legal experts.
And I certainly do understand why it is difficult, if not impossible, for other Republicans to step up and defend Lucas as it would seem like a wholly partisan defense of “one of their own”, but I reiterate that the public, Republicans, Democrats and Independents along with non-voters, must ensure that established cases and processes for such “crimes” are consistent and fair as there will come a day that any of one of can be arbitrarily singled out and subjected to an indefensible level of scrutiny and punishment.
