Atlantic Highlands Man Arrested For Kiddie Porn Possession and Distribution
Brian Foley, 60, of Asbury Ave in Atlantic Highlands, was arrested yesterday and charged with possessing and distributing images and videos which depict the sexual exploitation or abuse of a child, Monmouth County Prosecutor Christopher J. Gramiccioni announced this afternoon.
Foley is charged with one count of second degree Endangering the Welfare of a Child (Distribution) and one count of second degree Endangering the Welfare of a Child (Possession).
The State’s investigation and initial forensic examination of Foley’s devices revealed evidence that he has possessed and distributed images and videos which depict the sexual exploitation and abuse of a child.
If convicted of second degree Endangering the Welfare of a Child (Distribution), Foley faces five to ten years in a New Jersey state prison. If convicted of second degree Endangering the Welfare of a Child (Possession), he faces five to ten years in a New Jersey State Prison. Should Foley be convicted of either crime, he will be subject to the provisions of Megan’s Law and to Parole Supervision for Life.
Foley is in the custody of the Monmouth County Correctional Institution in Freehold.
UPDATE: Foley had his first court appearance today and was order released pending trial with the conditions that he have no contact with anyone under 18 years of age and that he have not computer access.
