Court Reverses Itself, Carl Lewis Is Off The Ballot

Politickernj and the Star Ledger are reporting that the three judge panel of the Third District Court Federal Appeals Court reversed its earlier order that Carl Lewis be on the ballot as a State Senate candidate in the 8th legislative district.

Lt. Governor Kim Guadagno, acting in her capacity as Secretary of State, had ordered Lewis off the ballot because he does not meet the state constitutional residency requirement.  Today’s order affirms Guadagno’s position.

Politickernj said that the Democrats might make Lewis an Assembly candidate since the Assembly only has a two year residency requirement, compared to the Senate’s four year requirement.

    Right or wrong, the Lt. Governor should not be the one to be making a decision like this.

    I will be interested in seeing the court opinion on the second reversal. It is difficult enough to get appellate decisions that reverse trial courts in the first place. It’s rare to see a court reverse it’s own reversed decision without a further appeal. Judges just don’t do that very often.

    The only reason I’m sorry to see Lewis off the ballot is now, we will not be entertained by the ignorant, idiotic responses to any questions related to an issue. Could you imagine his discussion of prevailing wage, fixing the pension system, health benefit costs, etc.? Would be funnier than his embarrassing rendition of the National Anthem.
