Toni Ann Marletta, the woman who killed 15 year old Marissa Procopio of Atlantic Highlands on Route 36 in Leonardo on July 7, 2015, has been granted parole. She is eligible to be released from State Prison on November 9, 2020.
Toni Marletta, the 52 year old Leonardo woman who struck and killed Marissa Procopio, 15, of Atlantic Highlands in a hit and run incident on July 7, 2015 will remain in state prison until at least May 8, 2019, according to the NJ Department of Corrections website. She had been eligible for parole this coming May, the victim’s mother, Danielle Procopio told MMM.
Danielle told MMM that Assistant Monmouth County Prosecutor Meghan Doyle informed her this morning that Marletta’s May 2018 parole was denied. Danielle had been waiting for a date with the Parole Board to make a statement and present a petition with over 1500 signatures opposing Marletta’s release when she got the news from Doyle.

The sentence is for the same term agreed to by Marletta in a plea agreement in which she admitted to leaving the scene of a motor vehicle accident resulting in a death and endangering the welfare of minors…Procopio and three teenage girls, including Marletta’s daughter, who were in the car when Marletta killed Procopio. Toni Ann Marletta, the woman who struck and killed 15 year old Marissa Procopio of Atlantic Highlands on Route 36 in Leonardo on July 7, 2015 and left the scene, will be resentenced for the crimes she pleaded guilty to on December 15.
A two-judge panel of the Court’s Appellate Division vacated Marletta’s 7 year sentence for Leaving the Scene of a Fatal Accident and 4 year sentence for Endangering the Welfare of a Child on October 25, according to a report published by The Monmouth Journal. The Appellate Court ruled that the Trial Court shall not consider one of the aggravating factors of the case and shall consider two mitigating factors in the resentencing. Freehold- Toni Ann Marletta, the 51 year old Leonarado woman who admitted to the hit and run death of Marissa Procopio, 15, of Atlantic Highlands, was sentenced to seven years in State Prison today by Judge Ronald Reisner in Monmouth County Superior Court. The seven year sentence for leaving the scene of a motor vehicle accident that resulted in a death runs concurrent to her four year sentence for Endangering the Welfare of a Minor.
Marletta was taken into custody at the conclusion of her sentencing hearing.
Toni Ann Marletta, 50, of Leonardo, said “I found that out,” when asked by Assistant Prosecutor Meghan Doyle if she was aware that Marissa Procopio had died as a result of being stuck by the car Marletta was driving on Route 36 on July 7, 2015.
In her allocution, Marletta said that she fled the scene of the accident because she had let her insurance lapse two months earlier. She admitted asking the children, her daughter and two others, who were passengers in the car not to talk about the accident until she figured out what she was going to do about it.
Marletta pleaded guilty to Leaving the Scene of a Motor Vehicle Accident that resulted in a Death and to two counts of Endangering the Welfare of a Child this morning before Superior Court Judge Ronald Reisner in Freehold. Under a plea agreement, the prosecution is recommending a sentence of 7 years for Leaving the Scene and 4 years for Endangering—to be served concurrently. Marletta will also face fines and a license suspension for motor vehicle infractions including having no insurance.

FREEHOLD- Toni Ann Marletta, the 50 year old Leonardo woman accused of killing Marissa Procopio, 15, of Atlantic Highlands, in a hit and run incident on Rt 36 on July 8, 2015, accepted a plea offer that carries a seven year sentencing recommendation during a case conference in Judge Ronald Reisner’s Courtroom in Freehold this morning.
Marletta is scheduled to plead guilty to Knowingly Leaving the Scene of a Motor Vehicle Accident which resulted in a death, a Second Degree Crime, two counts of Third Degree Endangering the Welfare of a Child and one count of second degree Endangering the Welfare of a Child on September 16th in Judge Reisner’s Courtroom. Her sentencing is scheduled for December 2.

Toni Ann Marletta, the 50 year old Leonardo woman accused of killing Marissa Procopio, 15, of Atlantic Highlands, in a hit and run incident on Rt 36 last July, pleaded not guilty to Knowingly Leaving the Scene of a Motor Vehicle Accident which resulted in a death, a Second Degree Crime, two counts of Third Degree Endangering the Welfare of a Child and one count of second degree Endangering the Welfare of a Child this morning during her arraignment in Judge Ronald Reisner’s Courtroom in Freehold.
Assistant Monmouth County Prosecutor Meghan Doyle told Judge Reisner that the State has offered Marletta a plea deal which carries a 7 year sentence in state prison. Marletta has until September 6, the date of the next case conference, to accept that deal.
Peter M. O’Hara, Esq, Marletta’s defense attorney, said that he would be filing a motion to suppress some the the evidence against his client.
Toni Ann Marletta, the 50 year old women accused of killing Marissa Procopio, 15, of Atlantic Highlands, in a hit and run incident on Route 36 in Leonardo last July, had cocaine and alcohol in her system at the time of her arrest.
Danielle Procopio, Marissa’s mother, said that investigators from the Monmouth County Prosecutor’s Office and the Middletown Police Department shared the results of a toxicology report with her prior to Marletta’s indictment for leaving the scene of an accident that resulted in a death, endangering the welfare of a child and other charges.
In an interview with MMM, Danielle said she is frustrated that Marletta is not being charged with vehicular homicide.
Toni Ann Marletta, the Leonardo woman accused of the hit and run accident that resulted in the death of 15 year old Marissa Procopio last July 8, was indicted by a Monmouth County Grand Jury on Monday, May 16, according to a copy of the indictment released by the Monmouth County Prosecutor’s Office.
Marletta stands charged of one count of Knowingly Leaving the Scene of a Motor Vehicle Accident which resulted in a death, a Second Degree Crime, two counts of Third Degree Endangering the Welfare of a Child and one count of second degree Endangering the Welfare of a Child. The Third Degree Endangering Charges are related to the children who were passengers in the car driven by Marletta when it struck and killed Procopio. The Second Degree Endangering Charge is related to the deceased teenager, Procopio.
